General

There are no representations, warranties or conditions with respect to the goods, and all other representations, warranties or conditions, express or implied by law, are hereby expressly excluded.

Seller’s Liability

The Seller shall not be liable for any claim arising under this sale.

Under no circumstances shall the Seller be liable for any claims for the Buyer’s loss of profit or for special, indirect, consequential or punitive damages.

Seller’s liability with respect to any claim of any kind arising out of the sale or use of the Goods, whether based on warranty, negligence or other cause, shall not exceed the cost of repair or replacement of the Goods.

Indemnity by Buyer

The Buyer agrees to indemnify and hold the Seller harmless against all costs and expenses incurred by the Seller as a result of the Buyer or any of its agents, employees or customers making any alteration to the Goods or as a result of a breach by the Buyer of any representations, warranties or obligations hereunder.

Purpose of the Site

The purpose of the Site is to provide you with information about NicoBloc and our products. In addition, you may purchase products through the Site.

Payment

When you click on “Purchase” at the checkout, you agree to buy the Goods at the prices indicated including any delivery charges and taxes that apply to your purchase. All orders will be subject to these conditions.

If your order is accepted, you will asked to confirm your order by clicking “Purchase”. As the confirmation is sent to you automatically, please check the order confirmation carefully to ensure no errors have been made. NicoBloc retains the right to cancel the order if necessary.

You are responsible for any payments due for any products or services ordered online. If we do not receive payment from your credit issuer or its agents, you agree to pay all amounts due to us. You shall also be responsible for any costs of collection of overdue payment.

Sales Tax

We are required by law to charge applicable sales tax on products shipped to those states that charge such a tax and in which we operate.

Shipping and Delivery

Your order from NicoBloc will be delivered via USPS. Unless we have stated otherwise in writing, delivery dates are not guaranteed, although we shall make every reasonable effort to deliver the goods by any quoted delivery date. The checkout procedure will provide you with the shipping costs. Items in-stock ship within 7-10 business days.

Delivery guarantee: Once the carrier has picked up your product, it is their responsibility to deliver the product to you. Out of stock products: while you may still order the product, your order will not be sent until we can fulfill your complete order.

Tracking: If the customer provides a valid email with their order, they will receive an email with a tracking number. Please note that if you have SPAM protection on your email account, you may not receive this email.

Return Policy

NicoBloc is 100% guaranteed.  If you are not completely satisfied please return the unopened boxes along with your order confirmation email or packing slip to: NicoBloc USA, 11 Grumman Hill Road, Suite 1A, Wilton CT 06897 within 30 days of purchase for a full refund.  Any further questions in regards to shipping can be directed to: cs@nicoblocusa.com

Auto-Ship Program

Our auto-ship program allows our customers to automatically be charged for and receive an order once every month. On the appropriate day, we will process your credit card for the agreed monthly fee. Your credit card information will have been securely stored with our payment provider and is not accessible through the website, the call center, or our customer service staff. If there is any problem with your card, you will be notified by email or phone. The day after payment has been successful, your order will be shipped to you.

When signing up for the auto-ship program, you agree to be signed up for a minimum of two months. After two months, if you wish to cancel out of the auto ship program, please call our Customer Service Department at 877-252-1073.

Customs and Damaged Goods:

All damaged and missing items must be reported to cs@nicoblocusa.com within 48 hours of receipt of your product. If you receive a damaged or defective item, we will promptly send you a replacement or issue you a full refund after you have returned the damaged or defective product. You will not be charged any additional shipping or handling fees for replacement of such damaged or defective shipments.

You will own the items we supply you from the moment they are put in the hands of the shipping service, or with our carriers, or on payment in full of the price of the Goods and any delivery charge, whichever is later.
